Samsung has been denied a preliminary injunction against Apple’s iPhone 4S, reports Florian Mueller of FOSS Patents. The court denied the request for a preliminary ban on the sales of the device in Italy just today.
This motion was brought by Samsung in October of last year, when samsung stated that “Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology. We believe it is now necessary to take legal action to protect our innovation.”
Samsung had also attempted to block the launch of the iPhone 4S at all in Italy, and when that request was denied, it turned to an injunction on sales. Samsung has accused Apple of infringing on two patents related to Wideband Code Division Multiple Access (WCDMA) standards for 3G phones.
Samsung had previously brought an argument for a ban in France as well, but that was denied late last year. Now the Italian efforts have also been stymied, at least for now. This has marked a trend of late, with many of Samsung’s efforts to block the sale of the iPhone 4S being shut down.
In one recent judgement, which stands out as a rare victory, the company was able to overturn a recent ban of its Galaxy Tab 10.1 device in Australia, allowing it to offer it throughout the Christmas season.
