Taiwanese prosecutors have indicted nine people over the alleged illegal export of high-end AI servers to China, among them an employee of Nvidia’s Taiwan operation and two from Super Micro.
The charges are the first to emerge from an investigation that has run for months, having already produced detentions over server smuggling and reached inside Nvidia itself.
The mechanism prosecutors describe is documentary rather than technical. The group is accused of producing false paperwork stating that 130 Nvidia B300 servers would remain in Taiwan, when the intention was to move them to Chinese customers.
Seventy-four of those servers made it out, routed through China, Indonesia, Japan, and Hong Kong before reaching their buyers. Taiwanese customs intercepted the remaining 56, which had been declared for Japan.
Eight of the nine face charges of breach of trust and document forgery. The ninth faces separate charges relating to the alleged siphoning of funds from a distributor, which suggests prosecutors see an element of ordinary fraud alongside the export offences.
“Colluded with one another at various levels for enormous profit, illegally exporting high-end servers,” was how prosecutors characterised the arrangement. No individual defendants have been named publicly, and no value has been placed on the shipments.
The B300 is precisely the class of hardware US export controls were written to keep out of China. Restrictions on Nvidia’s advanced accelerators have required licences for Chinese destinations since 2022, and the transshipment routes named in this case are the ones enforcement agencies have been watching for years.
Japan features prominently, which is consistent with earlier findings. Taiwanese authorities previously suspected Nvidia chips were being routed to China through Japan, and the 56 intercepted units were declared for that destination.
What the case does not allege is a technical breach. No hacking, no diverted manufacturing, no counterfeit hardware, just paperwork stating one destination while the goods travelled to another, which is how most export control cases actually work.
Neither Nvidia nor Super Micro is charged as a corporate entity, and both have consistently framed the matter as the conduct of individuals rather than company policy. Super Micro confirmed earlier in the investigation that two of its Taiwan staff had been detained, and its Taipei office was raided as the probe widened.
The economics behind the smuggling are not subtle. B300 servers have sold in China at roughly double their US price, which creates a margin large enough to tempt people with access to legitimate supply chains and the documents that move through them.
Nvidia has been publicly dismissive of the trade’s strategic value, with Jensen Huang arguing that smuggled data centres are a dead end because they cannot be serviced, updated, or supported. That may be true at data centre scale, though 74 servers is a quantity a determined buyer can maintain without official help.
Taiwan has been tightening its own regime in parallel with Washington’s, adding Huawei and SMIC to its export control list and prosecuting cases under domestic law rather than waiting for American enforcement. This indictment is a product of that shift.
For Taiwan the case is as much about its own standing as about American rules. The island sits at the centre of the advanced computing supply chain and has an obvious interest in demonstrating that goods passing through it do not leak, particularly to the country most likely to be their destination.
The wider pattern is that enforcement has moved from the companies to the people inside them. Super Micro’s co-founder has separately been charged over server smuggling, and a former Google engineer’s conviction for stealing AI trade secrets stood on appeal even as espionage counts were overturned.
The indictments now go before the courts, where the defendants will have the opportunity to contest the charges. Prosecutors have not indicated whether the investigation is complete or whether further charges are expected.
