ok found it, the verdict is a bit more nuanced than described above.
http://www.iept.nl/files/2009/IEPT20090513_Rb_Amsterdam_Zwartepoorte_v_Schoonderwoerd.pdf

unfortunately only in Dutch. the judge says Schoonderwoerd also has an own responsibility, as he set op his site in a way that he scores high in google.

The ruling is ridiculous. As a sign of civi disobedience, let's try to get the words "Zwartepoorte" and "failliet" indexed as much as possible by Google. Zwartepoorte failliet

Presumably if Google index the case summary from the judge, the judge can be sued. The judge must have have mentioned both the name of the company which was doing the suing and the word "bankruptcy" somewhere during the summing up.

Beware producing an encyclopedia or dictionary because somewhere in that will be every word in the language. If Google put it together in a bad way then you'll be sued.

What about directories of businesses and their phone numbers. The mind boggles!!
